SEC. 1679. The master of any vessel arriving at a port in the Philippine Tolands having firearms, gunpowder, cartridges, dynamite or any other class of explosives and munitions of war concealed on board his veesel, or not contained in the ship's manifest, shall be liable toa fine of not exceeding four thousand posos,and all of such articles, together with such vessel, shall be gaizod and forfeited,

SEC. 1680. Except as provided by the last preceding section, it any merchandise be found on board any vossal from a forsign port which is not included in her manifest, produced as requirod by this title, the mster shall forfeit an amount equal to doublo the duties fixed therefor: PROVT03D ALWAYS, That if it appears to the collecter that such omissione ocurred with intent to defraud the rovenue, the mastor shall in addition forfeit an amount oqual to the value of the merchandise not manifestol, and all such merchandise belonging or consigned to the officers or crew of tha vassol shall) e seized and forfeited; but if such morchandiso belongs to any other person acting in good faith the same shall be released upon payment of the regular duties and chargos thorgon. If any package or article named on the manifest bo mie sing on the arrival of the vessel, or if the merchandise on board does not otherwise agree with the manifest delivered by the manter, excapt as above proscribed, the master shall be liable to a penalty of not less than five hundred pagos and not more than five thousani pasos, and in addition an amount equal to the value of the said mis sing merchandise as ascertained by the collector of customs, unless the collector shall be satisfied that such deficiency or flangraenont occurred without fraudulent intent, in which case said penalty shall not be inflicted: PANTIDED, NEVERTHELESS, That if such disagreement or deficiency is found by the collector to be due to the careless- ness, negligence, or incompetence of the master of the vassal her owners, or agents a penalty of not more than the value thereof may be imposed upon the mastor for each packages missing or materially disagreeing in marks, character, or otherwise with the description thereof in the manifest.

All penaltios inflicted under the provisions of this section shall be forthwith reported to the Insular Collector with full particulary of the offense committed and of the previous conduct of the master in like matters.

REC. 1690. Thenover in the judgment of the collector of customs there has been a vistion of this title, or of any customs, navigation, immigration, or exclusion Act, subjecting any merchand- ise, veasol, animal, or other property to the satisfaction of a fino, penalty, confiscation, or forfeiture, the collector of customs shall Collector's seize the property, proceeding, as in section seventeen hundret and twelve hereof, and shall notify the owner of the merchandise, vessel, animal, or other property, or his agent in possession, in writing, of the fact, giving to such person or owner or agent an opportunity to be heard in reference to the offenses charged, and after such hearing the collector of customs shall fix in writing. the fine or penalty which in his judgment ought to be imposed and the description and value of the merchandise, vessel, animal, or other property which should be confiscated or forfeited.
